Dear Ms. xxx,


This letter pertains to the Contract of Lease that you (lessee) and I (lessor) executed on xxx, wherein in the said contract, that as the Lessor leased property my property known as xxx, xxx to you for a period of one (1) year in consideration of a sum of money amounting to Seven Hundred Fifty Thousand Pesos (Php 750,000.00)

 

Based on the Contract, the following conditions were agreed upon, to quote:

 

“3. USAGE OF EQUIPMENT, FURNITURES, APPLIANCES, ETC: The LESSEE shall utilize the equipment, furniture and other things inside the rented premises, provided that they shall take good care and maintain the quality of the said equipment, furniture and appliances. xxx. In case there are losses and destroyed items, the LESSEE shall replace it or repair the said items.

6. UTILITIES: Any and all expenses and/or bills corresponding to the use and consumption by the LESSEE of any utilities, such as but not limited to electricity, water, and telephone services during the duration of the lease agreement shall be paid by and be for the account of the LESSEE.

 

7. REPAIRS AND MAINTENANCE: During the term of the contract, the LESSEE agrees that all ordinary repair and maintenance of the leased premises shall be for their exclusive account without any right of reimbursement from the LESSOR.

9. DAMAGES: The LESSEE shall be liable or responsible to the LESSOR for any loss or damages on the premises due to the fault of the LESSEE, their employees, agents, customers or guests.”

 

 

In view of the above-quoted item provisions of the Contract of Lease, provides that you, as a lessee has the following obligations:

 

1.     to take good care and maintain of the furniture and appliances and other things inside the rented premises and to be responsible for its loss and destruction;

2.     to pay the bills corresponding to the use and consumption by the LESSEE of the electricity;

3.     to make ordinary repair and maintenance of the leased premises without right of reimbursement from me; and

4.     to be liable or responsible for any loss or damages on the premises due to the fault of the LESSEE

 

However, you failed to do so. When the said contract expired xxx, I just discovered that there were electricity bills from Meralco which were left unpaid by you totaling Forty-Seven Thousand Nine Hundred Five Pesos and Fifteen Centavos (P 47, 905.15) which I had already paid on xxx otherwise electricity supply will be disconnected.

 

Furthermore, upon inspection of the premises and the equipment, furniture, and appliances destroyed and were not already in proper condition, such as but not limited to electric fans, chairs, bed banks, the decorations, the air conditioner and the likes. Likewise, the electric wirings were damaged due to your fault. With these, I have to repair and make renovations on the leased premises and replace some of the equipment, furniture, and appliances thereon.

 

Please take note that I have incurred the following expenses in the repair, renovation etc. to restore the good condition of the leased premises:

 

1.     Materials

2.     Cost of Labor for Electrician

3.     Cost of Labor for Carpenter

 

Therefore, I am asking you to make necessary arrangements for the payment in full of the expenses I incurred in order to settle electricity billings, repairs and renovations needed in the leased premises and the replacements of the equipment, furniture and appliances thereon within ten (10) calendar days from receipt of this demand letter.

 

Otherwise, I will be constrained to take the necessary legal action to enforce your legal obligation and any legal rights under our Contract of Lease. However please take note of this provision stated on the said contract, to quote:

 

“Should the lessor be compelled to seek judicial relief against the LESSEE, the latter shall in addition to any other damages that may be awarded to the LESSOR, pay an amount equivalent to TWENTY FIVE (25%) of the amount claimed in the complaint, as and by way of attorney’s fee’s with the minimum of FIFTY THOUSAND PESOS (P50, 000.00), aside from the costs of the litigation and other expenses the law may entitle the LESSOR to recover from the LESSEE.”
